The Emery County Attorney’s Office has filed an information in the Seventh District Court charging Kaylene Pearson, Huntington, with misuse of public money, a third degree felony, and forgery, a third degree felony. These charges involve her alleged misuse of money in connection with her position as treasurer for the Southeastern Utah Junior Livestock Show. This case is assigned to Judge George M. Harmond Jr.
In count one misuse of public money, is ammended as follows: That between Jan. 1, 2001 and Dec. 31, 2008, the defendant did as a public officer or other person charged with receipt, safekeeping, transfer, disbursement or use of public monies did appropriate the money or any portion of it to her own use or benefit or to the use or benefit of another without authority of law; loan or transfer the money or any portion of it without authority of law; fail to keep the money in her possession until disbursed or paid out by authority of law; or unlawfully deposit the money or any portion in any bank or with any other person. A third-degree felony.
In count two forgery in violation of Utah Code as amended as follows that on or about Dec. 22, 2007, the defendant did, with purpose to defraud anyone, or with knowledge that she was facilitating a fraud to be perpetrated by anyone, make, complete, execute, authenticate, issue, transfer, publish, or utter any writing so that the writing or the making, completion, execution, authentication, issuance, transference, publication or utterance; purported to be the act of another, whether the person was existent or nonexistent; or purported to be an act on behalf of another party with the authority of that other party. A third degree felony. The defendent will have a first appearance in Seventh District Court on Oct. 27 at 9 a.m.
