Counsel informed the court the defendant will waive the preliminary hearing. The state objected. The state indicated it was informed the day prior of the defendant’s intent to waive the preliminary hearing. The state called off their witnesses. The state informed the court the federal court is looking to indict the defendant and the state feels the defendant is trying to avoid federal prosecution by entering his plea in the district court. The court was unhappy that the state was aware of the waiver and now objects. The court recessed to research the options when the state objects to a waiver of the preliminary hearing. The court has two options to follow. The court decided to continue the matter and set the preliminary hearing for Aug. 21 at 10:30 a.m.
