USA-All recently announced that the lawsuit it had filed against Emery County on May 3, has been withdrawn. The group has since been convinced that Emery County officials have been acting appropriately as far as the RS-2477 road issues are concerned.
In the lawsuit, USA-All had claimed that the state and county officials have failed in their duty to keep roads open and have failed to assert the county’s rights to the RS-2477 roads. Paul Mortensen, attorney for the group, has since stated that USA-All is satisfied that those rights are being properly addressed.
As the dispute continues about what constitutes an RS-2477 road, USA-All reserves the right to reinstitute the lawsuit. Meanwhile, the state has threatened to renew its suit against the interior department concerning RS-2477 road claims.
